Simms Showers delivers effective, responsive, sophisticated litigation solutions for its clients in complex business litigation, at a quality and value exceeding many larger firms.

Our complex litigation practice ranges from antitrust to insurance coverage, from RICO and securities to reinsurance, from intellectual property to real property, in federal and state courts across the country. In order to assure control of litigation costs, we work in appropriate matters according to litigation budgets, guaranteeing that fees and expenses will not exceed 5% of the budget. The work of Simms Showers and its principals in the area of complex litigation has included:

  • Successful conclusion of a Medicare fraud case with an U.S. $8.6 million settlement paid by a national medical testing laboratory, which was the nation's third largest False Claims Act recovery;
  • A complex international insurance fraud case, resulting in a judgment for our client of US $1.4 million;
  • Successful conclusion of a US $4 million lender and directors' and officers' liability civil racketeering claim;
  • A US $5 million suit alleging civil RICO and legal malpractice after a financial institution collapsed, also concluded successfully;
  • A defense verdict in favor of the former Chief Financial Officer of Maryland's largest health insurer in a $50 million action brought by that insurer's subscribers.

Simms Showers also represents clients whose litigation matters are considerably more basic than the examples described above, ranging from basic contract and business disputes to motor vehicle accidents

Simms Showers or its principals has successfully defended a range of complex business matters in the area of professionals’, officers’, and directors’ liability, including a $4 million lender and directors' and officers' liability civil racketeering claim, a $5 million suit alleging civil racketeering and legal malpractice after a financial institution collapsed, and claims against the former Chief Financial Officer of Maryland's largest health insurer in a $50 million action brought by that insurer's subscribers. The Firm advises corporate officers, directors, and professionals about how to avoid liability, as well as how to assure that they receive coverage from their insurers.

Mr. Simms served as Chair of the American Bar Association, Tort and Insurance Practice Section Professional, Officers and Directors Liability Law Committee, and has written widely on the law affecting corporate directors, officers, and directors, including Homeowner’s Insurance, Directors and Officers’ ("D&O") Liability Coverage, Insurance Law: Third Party Coverage in Maryland (Nat’l Business Inst. 1996); Insurance Requirements in AIA Contracts, ABA-TIPS 1996 National Institute on Insurance Coverage for Defective Construction; The Internet: International Civil and Criminal Liability, Maryland Bar Journal 36 (Sept.-Oct. 1996); Recognizing and Avoiding Conflicts of Interest and Non-Profit Board of Director "Boobytraps," 1995 Non-Profit Risk Management Institutes, Washington, D.C.; Directors' and Officers' Duties to Creditors Upon Corporate Insolvency and to ERISA Plans and Beneficiaries, Current Developments in the Law Affecting Corporate Officers and Directors (December, 1993); Directors' Fiduciary Liability to Third Parties in Partnership and Bankruptcy 1993:2 ABA TIPS Professional, Officers' and Directors' Liability Newsletter 3; Directors' and Officers' Liability from "Too Much" Control?, 1993:1 ABA TIPS Professional, Officers' and Directors' Liability Newsletter 3; Liability for Officers and Directors in Environmental, ERISA, Civil Rights, FIRREA, and Other Areas After Trans-Union, Current Developments in the Law Affecting Corporate Officers and Directors (March, 1993).
