Simms Showers’ experience in the area of intellectual property litigation includes the defense and prosecution of internet domain name disputes, and of alleged patent, trademark, and copyright violations.  The Firm or its principals have successfully defended patent infringement suits involving patents for agricultural pesticide products, and alleged copyright infringement in computer-related litigation.

Simms Showers serves a variety of clients dealing with intellectual property, particularly in the areas of trademark and copyright. The Firm encourages for-profit and non-profit clients to seek protection for their brand within the United States at the federal level.

The Firm assists clients in

  • preparing applications for registering intellectual property;
  • discussing, reviewing, and editing specimens and samples for submission to the respective federal agencies;
  • researching and analyzing potential concerns and alternatives available in registering clients’ intellectual property with federal agencies; and
  • reviewing and responding to correspondence from federal agencies regarding the applications.

After registration, the Firm advises clients on using the registration to best protect their intellectual property, such as limitations of use for their registered mark and licensing of their brand to third-parties. The Firm also monitors and notifies clients of any correspondence, renewal notices, or alerts concerning their intellectual property registration to maintain their protection under federal law.

The Firm also works with and provides counsel to our clients seeking to expand and protect their brand internationally, including countries who are and are not party to the Madrid Protocol.
